The only impact will be that you will lose your earlier PD (if 140 gets approved).......Also, it could cause you issues with H1 extensions if you are in 6th year of your H1 and are re-starting the GC process....Note that your LC/I-140 must be filed or should be pending for 365 days or your I-140 must be approved in order to get H1 extensions beyond the 6 year term....

First of all you would need a visa to visit UK.

I don't think Malaysian nationals residing legally in US and travelling to UK need a visitor visa...But I am not sure if UK visa law considers pending I-485 (AOS) a valid status....If you still maintain a valid H1 status but plan to re-enter on AP, you should be ok in my view...

Hello Folks:

This long wait for Green Card has made me think about a number of things...

A few days back a couple of my friends have recieved notices from USCIS are sending notices 'Intent to Deny their I-485' w/o any rhyme or reason. Employer says they have not withdrawn their I-140. They said they will appeal but if nothing happens they will go back to India.

Just worried...if this happens to me and I am forced to go out of the country in 30 days, what happens to my US loans. I do not think I would be able to repay back my home & car loans with an Indian salary if I return. In this market I can only sell at a huge loss. I also used US Line of credit for education purposes. Do I need to file bankruptcy? I am on a EAD right now...

Any thoughts on this... greatly appreciate ....it

The job does not need to require Masters degree. Unlike Greencard filing under EB2 vs EB3 it is not any harder to get H1 under Masters quota, all you need is Masters from accredited univ. You need to figure out what the RFE is for.

Hi

After changing the address on sunday, there were soft luds for 2 days on all pending 485.

Is this same with all address change.Last time it took 3 weeks to get the letter.

Any experiences?

It would be interesting to split the poll as: Apr-May, June-July, Sept-Oct and Nov-Dec 05. I know there r not many between apr 05 and sept 05. but there is a lot in mar05 and sept to dec05 as labors under perm started clearing after sept 05.

My PD is current and my I-140 approved. I received below RFE on my pending I-485 related to my name listed differently on documents.

RFE words are listed below.

NAME DIFFERENCE:
Submit documentary evidence to establish that Pravin Bhalla, Pravinkumar Bhalla and Praveenkumar Bhalla are the same person. The most persuasive evidence is photo identification in each name. If the last name is different due to marriage, submit the marriage certificate. Note: Affidavits will not be considered primary evidence.

I don't have a lawyer for my I-485. Any help on how to answer this REF will be great help.

Thanks for looking at this question:

Scenario: I was working for company A on H1 (valid until 2010) and filed a GC through a company B (Head Hunter Company) for future employment, I have my 140 approved, and 485 was filed June 2007, have an EAD/AP. Got a RFE for intent of employment was satisfied with a letter from Company B that "I intend to join company B subject to my favourable adjudiciation". Company A is going under because of lack of funds.

Questions:
Now I am searching for a job, I am getting job offers.

1) Either I will do a contract through through Company B for which I do not have to anything in terms of immigration right?

2) But if I strart working for Company C's payroll then I am going to have to do an AC21 right or can I still hang on to company B.

3) If I do AC21 through company C and if the Job description is pretty close to the description on the LC then would it be okay or do I fear rejection? Or will I be asked why I did not work for the company who filed for my GC in the first place.

Please throw some light on the best option I have.

You started you GC as future employement with company A. You never joined them and want to use AC-21 which will raise red flag. So you need to need to very careful.

Currently i have my I-140 approved an that is all i know. To be honest, PD to me means "the day my I-140 was approved". Is that true??

My wife lives with me on H-4 and she will hopefully get an ITIN this year. Now, how i understand the system, i cannot file for I-485 petition until, the date of my I-140 approval becomes current. Please verify to help me understand this system. Thanks in advance.

My case is similar too, my husband filed 485 for both of us on 29th June, we both have H1b. But on June 15th one H1b transfer was filed for me (dependent in 485) which was confirmed to us on June 22nd and I joined new company on June 26th.
But the whole transfer thing is not mentioned in 485 because we were not aware at time of filling forms (june 18th).

Is this going to create problem? do we need to send update/form to USCIS about this?

I would wait it out if I were you. Why the risk at this stage?
Risk/Benefit analysis is not in favour of anything but staying put if you ask me.
What if in the 8-9 months it will take to get to this stage, the EB3 date skips forward, worse yet what if they take a hard stand on conversion cases due to the number they are seeing and you get denied.
It all depends of course on your personal circumstances, but I can't see the logic in it.

One will get a H1-B without I-94 if the person is outside of USA.

so basically you need to go for stamping to the local consulate for the visa.



For your second question - no you don't have to be present in the US to file for the extension .

I know this is irrelevant in a way but see it from a different angle for one moment. There is no other forum where you can get any information about these H1 employers who are playing games using retrogression. This is the only forum where most of the people on H1 are related to some desi consulting company and can share their experiences which would help other people who are in huge pain due to the unfair practices of their existing employers.

I would recommend the administrators to create a separate area on this forum where people can share these experiences and find genuine employers.

Not in this forum I would argue. There are other places.
