I moved to a new company and yet to receive my I-797 approved from INS. My old company visa is valid till May 2010. If they have not revoked it can i still travel out of country and come back?
You should not return showing just the old visa and approval notice for Company A. That would be misrepresenting to CBP that you were still working for Co. A. You need to show the receipt for Co. B's filing to show that you are working for them using portability (I assume you are)

I was on H1.. but i quit my job and i am currently enrolled as a Full time student.
I need to go to Mexico as part of my Study program....
I have received the change of status from USCIS..but i need to get my passport stamped..
I have not been successful in getting an appointment in Canada....

i am not sure you can get an F1 stamp in either Mexico or Canada. You can only get an F1 stamp in these countries if you already have an F1 stamp, but it expired and you did not hold any other non-immigrant status in the interim.

Does anyone have any names and suggestions on the best lawyers in the US? Dan19, could you please tell me which lawyer the person consulted with who got his LC approved? I have contacted Carl Shusterman and have a phone appointment with him on Monday. Any ideas would be appreciate since I don't have much time left cuz I need response to the letter by Sept 27, which is two weeks from now.
I really appreciate everyone's input on my labor certification problem. The letter I got from the labor department is a letter with intent to deny application which means my LC is not denied yet but that they are considering of denying it if I couldn't provide evidence to explain why the job description is restrictive. On the letter however, I am not given the option to readvertise. So my lawyer plans to request for that but he said most likely the Labor department will not grant the consent for me to readvertise

H1, H4 (spouse) and H4 (kid) living happily.
File 485 and gets EAD/AP.
H1 doesn't use EAD.
H4 uses EAD and hence looses H4 status.
I-485 is denied.
Now, my understanding is that spouse has to go out of country and come back again on H4.
What about the kid?
When does the kid loose his/her H4 status? (When both mother and father use EAD)?
As long as primary stays in H status any derivative who does not change his H4 status will stay in H4 status. the only way a H4 can loose H4 status if he/she uses EAD. In your case if i have understood it correctly ur Kid will never use EAD and if you never used EAD ur H1 status is active thus ur kids H4 is active .. also i think ur wife can change her status back to H4 but would require her to file some paperwork .. she might need to geta visa stamp when she tries to re-enter into us..

I have received so many different responses regarding the shots required for over 65s. Our local health department, the INS Doctor and the INS all seem to be providing different information, I'm hoping someone can clarify.
The civil surgeon provided us with a list of shots, basically it contained all the shots including those that I thought were just for children. We went to a public health nurse today who gave us TDP and Varicella shots. Are the MMR, flu and pneumococcal shots required by the INS?
The INS approved Doctor wanted $600 per person for all of the shots. The exam and blood test were $120. We've decided to go to a private Doctor and the local health department for the shots instead of paying the $600. I'm hoping someone can clarify what is needed so that we avoid paying for shots that are not needed.

USCIS has recently published a new fact sheet of common questions and answers for members of the U.S. Armed Forces and their families. For instance, if you are a civilian, obtained your green card through a marriage to a U.S. Citizen and you have been married for less than two years, you must file Form I-751, Petition to Remove Conditions on Residence (http://www.uscis.gov/portal/site/uscis/menuitem.5af9bb95919f35e66f614176543f6d1a/?vgnextoid=f858d59cb7a5d010VgnVCM10000048f3d6a1RCR D&vgnextchannel=db029c7755cb9010VgnVCM10000045f3d6a1 RCRD) to remove the conditional residence and obtain your permanent green card. I mean stay on L1A (7 Year) with existing company. Apply green card through company B OR any other (For applying grren card, you don't need to be employee of that firm). Switch job as soon as you get I140 (premium process) approved from B company. If everything goes well, One year is enough to get I140 approval through premium process.

Anoop - dont worry about it and ask your company to reapply with a stronger educational valuation. Everything depends on the educational valuation report submitted along with the application.

My visa petition went to RFE first and when I enquired my employer they said that the consulate asked for education evaluation report and they have send it, but they didnt show me what they have send and unfortunately this years quota seem to be over, I have to wait for some more time :-(

I do not want to renew the advanced payroll, since I do not foresee travel within the next 18 months overseas. Is there a way I can skip the renewal this time around (1-year extension) and renew it the next time? If there is an emergency, I can still go to India and have the Visa-stamped since we have a valid H1/H4 right?

As I read from your post, you are saying that you do not have H1 visa stamped in passport. These days consulates in India are pretty tough and they are issuing 221(g) etc for H1/H4 visa. And you could be denied visa for no fault of yours. It happened to my wife and it took 3 months for the consulate to get the clearance. So think about it. Personally for me AP is a very important document it allows you to travel in case of an emergency.

as I said.. you can relatively edit the swf in flash.. let's say that flash doesn't know that the object it's in 3D.. for flash that's just another shape makin' your movie bigger.
importing your movie in swft format you'll have a little more control over it.. because the swift 3D flash importer separates highlights, shadows, objects, etc. to its own layer.
just in case you don't know how to import any file go to: File � Import

H1B LUDs may be due to PIMS data collection, I heard most of the H1Bs approved after Jan 2004 had LUDs and the status did not change; and 140 could be a regular system touch.
